Buyer regulations

Mimelis is a marketplace that allows you to directly reserve products from Swiss producers and artisans with a view to purchasing them. In order to ensure good cohesion between each actor, and to offer you the best possible purchasing experience, you will find below your rights and obligations as a buyer on our Platform.

These rules or “Buyer Rules” are part of our Terms of Use . We invite you to read them carefully, because by reserving products on our Platform, you accept these regulations as well as our Conditions of Use.

 

  1. Mimelis and its position as a marketplace

    1. Producers and artisans, or more generally “Sellers” make products available on the Platform in the form of an offer (“Product Offer”) so that they can be reserved and purchased by buyers (“Product Offer”). you” in this document).

    2. The Sellers themselves determine the terms of their Product Offerings according to which they intend to offer said products for reservation on the Platform. In particular, they specify for each Product Offer, its content and its price.

    3. When you reserve products on the Platform, we confirm their reservation to you using a reservation confirmation.

    4. When you reserve products and the Seller accepts your reservation, the Seller undertakes to put the products on sale to you. You and the Seller have the rights of revocation and recourse as provided in these Conditions.

    5. When you discover and then reserve a Seller's Product Offerings on our Platform with a view to purchasing them, it is important to note that Mimelis does not participate in this transaction. Therefore, you understand that Mimelis exclusively arranges the sale on behalf of the Seller and that consequently, there is no contractual relationship between Mimelis and yourself, both in terms of the products you reserve, and the sale of these products. Consequently, Mimelis declines all responsibility with regard to the execution of your agreement with the Seller or to the products.

 

  1. Booking Product Offers

    1. Consent. When you book on the Platform, you confirm that you are a consumer and are purchasing for personal use.

    2. General. The Platform presents you with lists of producers and artisans who may or may not offer you Product Offers available for reservation. These lists can be presented to you in different ways, for example in the form of a producer list or in the form of a Product Offerings list.

    3. Presentation. These lists can be created using geographic criteria and filtered using different criteria by yourself so that you see results that are relevant to you. For example, you can only display producers who offer Product Offerings or, when you authorize us to use your location, we can show you results close to you.

    4. Content of Product Offerings. Each Product Offer is written and detailed by the Seller himself. The Product Offerings and the details that may be provided by the Seller, in particular via their description, are intended to inform you about these Product Offerings so that you can evaluate them before making a reservation. It is possible that a Product Offering is not correctly updated by the Seller on the Platform and that you consult it. In this case, Mimelis assumes no responsibility in this regard. Sellers are required to provide accurate, complete and current Product Offering information at all times. Mimelis will not assume any responsibility when this is not respected by the Seller.

    5. Duty to be informed. When you express doubts regarding the content of a Product Offering, you are required to inquire and clarify any doubts or lack of information directly with the Seller before sending the reservation order on the Platform .

    6. Willingness to book. When you are interested in a Product Offering from a Seller and want to reserve it, you can add it to the list of Product Offerings you want to reserve from that Seller. You will then have the option to complete your order by clicking on a “Reserve”, “Reserve now” or similar button.

    7. Reservation. When you validate your reservation, your reservation order is considered as an offer to purchase the Product Offers that you have selected that you send to the Seller.

    8. Reservation order. As soon as you send the reservation order, Mimelis begins processing your reservation by sending the reservation order to the Seller. Mimelis then sends you a reservation confirmation to let you know that the reservation order has been sent to the Seller and that the reservation is being processed.

    9. Reservation confirmation. Your reservation confirmation contains information summarizing the reservation order. For example, it contains information on its contents or on the time slot where you should come and collect them. This is sent to you by email and you are required to keep it.

    10. Acceptance of reservation order. The reservation becomes definitively binding for the Seller and you when you collect the product, subject to the rights of revocation described below and the conditions provided for in these regulations.

 

  1. Right of revocation

    1. Right of withdrawal for products likely to deteriorate or expire quickly: we inform you that you will not be able to exercise any right of withdrawal concerning such products.

    2. Right of withdrawal for other products: To the extent that when you validate your reservation your reservation order is considered as an offer to purchase made to the Seller, and that, according to the concept of Mimelis, the Seller can, upon receipt of your purchase offer, you personally reserve the products, possibly anticipate their preparation with a view to your upcoming collection, and remove them from its sales circuit knowing that you will come and collect them, your purchase offer cannot be canceled .

    3. In very rare cases, the Seller may be required to cancel your reservation. In such a case, the entire amount deducted from you will be refunded to you, as provided in these Conditions.

 

  1. Opting out of Product Offerings

    1. All products contained in the Product Offerings which are made available by the Seller upon collection must be used, consumed where applicable, according to the product markings. Recovered products must be used or consumed according to the Seller's instructions or product labels. When it comes to foodstuffs, and, in the absence of the previous instructions, they must be consumed immediately after withdrawal.

    2. Products must be collected during the time slot selected and approved in the reservation order. Typically, this time slot is 30 minutes. The location and time slot for collection are indicated to you on the Platform and you accept them when you send the reservation order. This information can be found after booking on the reservation confirmation, either by email or directly from your customer account on the Platform.

    3. When collecting, you must be able to show the Seller your reservation confirmation from the Mimelis application. The Seller, either by manually entering the reservation code, or by scanning the confirmation or by a similar means, will validate your withdrawal and return the products to you. It is your responsibility to be able to provide the Seller, when collecting your products, with this reservation confirmation in the application.

    4. When you collect your products, it is your responsibility to check that the products and their quantities are correct, conform and correspond to your reservation order.

    5. If you arrive after the time slot you selected during your reservation, the Seller's collection point may be closed and/or your products may no longer be available. You will not be able to access any right of refund or discount of your products at a later date and you expressly accept this. Without being obliged to do so, the Seller may agree to return the products to you later. In such a case, Mimelis will not take part in this process in any way and will consider the contract terminated at the end of the withdrawal time slot.

 

  1. Delivery

    1. In the event that you choose to have your products delivered, the rules and conditions relating to delivery detailed in the Delivery Regulations apply. By choosing delivery you accept these regulations and the Regulations concerning delivery .

 

  1. Price and payment terms

    1. You have several payment methods to pay on the Platform, such as with a credit or debit card.

    2. All prices indicated on the Platform include current VAT. If there are costs linked to your order and/or depending on the payment method you have chosen, these costs will be displayed before you place the reservation order.

    3. The Platform uses a secure payment provider to complete all payments you make. Payments are processed through our Platform and our payment provider in a secure and SSL encrypted manner.

    4. When you want to send a reservation order with a credit or debit card, you must enter your card number, expiration date and your security code.

    5. When you place a reservation order or when you order on the Platform, the total amount of the Product Offers you have selected, which corresponds to the total purchase prices of the products decided by the Seller, is reserved in your account according to of the payment method you have selected. The purchase price of the products will be debited from your account, upon reservation, or, during or just after collection of the products, depending on the payment method you have chosen. In the case of delivery, the amount will be deducted from your account, upon ordering, or during or just after shipping the products.

    6. The purchase price of the products is collected by Mimelis but is made on behalf and in the name of the Seller.

    7. At its discretion, Mimelis may modify or make changes to its procedure for collecting the purchase price of the products. You will be informed (preferably by email).

    8. Mimelis never stores your credit or debit card data. This data will only be processed by the payment provider who may also save it.

    9. When you validate a reservation order by debit or credit card and your payment is accepted, your bank or the issuer of your payment method reserves the entire amount of the reservation order. In the event that the reservation order must be rejected by the Seller or canceled for any other reason under these Conditions, your bank or the issuer of your payment method will refund the amount of the reservation order to your account and not on that of Mimelis. This refund operation may take 5 to 10 working days. This period may be reduced or extended depending on your bank and the issuer of your payment method. Mimelis is not authorized to inquire about financial transactions from your bank or the issuer of your payment method; it will therefore be necessary to make such requests on your side.

    10. When you accept these Terms, you also accept the payment method described above and agree that Mimelis bears no liability in this regard.

 

  1. Responsibility

    1. Mimelis is not a party to the sales contract between you and the Seller, or any other contract between users of its Platform, and could in no case have its liability involved for difficulties which could arise during the conclusion or of the execution of the sales contract.

    2. Mimelis does not carry out control, moderation, specific verification of advertisements or control of any kind as to their content. As such, Mimelis cannot be held responsible for the content of the Product Offerings or more generally for any content introduced by the Seller on the Platform. Any possible complaint must first be addressed to the author of the content. In the event that content is harmful to a third party, it is possible to contact Mimelis so that it can take the measures it deems necessary. Furthermore, Mimelis reserves the right to carry out occasional moderations but is not obliged to do so.

    3. Mimelis is not in physical possession of the products that may be sold by Sellers on its Platform. As such, Mimelis is not responsible for the manufacture, purchase, sale, storage, preparation, production, processing, labeling, packaging, delivery or processing of products. Mimelis gives no guarantee on i) the conformity of the Product Offerings with the laws and regulations in force, ii) the conformity of the products contained in the Product Offerings, the existence of possible hidden defects, iii) compliance with the standards of storage, transport, conservation, handing over of products, delivery iv) management of products and rules of hygiene and maintenance.

 

  1. Right of appeal

    1. You undertake to contact Mimelis exclusively in the first place (and this, regardless of any possible recourse against the Seller) for any complaints or claims relating to the products that you have reserved on the Platform or/and the availability implementation of a Platform service, before taking any other steps.

    2. Any complaint must be transmitted immediately to Mimelis, as soon as you become aware of the problem.

    3. Mimelis then transmits the request to the Seller or/and processes it itself. Mimelis will then send you a response as soon as possible.

    4. In the event of a complaint, you must contact Mimelis using the link provided for this purpose in the application by going to the reservation in question. You must then detail which products are the source of your complaint, justify the reason for your dissatisfaction and express in an unambiguous manner your desire to withdraw.

    5. Following a complaint and in the event of an unsatisfactory response from Mimelis, you can send your complaint directly to the Seller in order to resolve the dispute with the Seller under applicable law. Unless otherwise agreed with the Seller, the products which are the subject of the complaint must be delivered directly to the Seller.

    6. If the products which are the subject of the complaint can be replaced by the Seller with strictly similar products, you are required to accept them. Otherwise, the products in question will be refunded to you partially or completely.

 

  1. Behavior

    1. Both during the reservation process and during the purchase and collection of products, you are required to behave respectfully and not derogatory, both towards the Seller and its staff and towards Mimelis and all of its staff.

    2. In the event of such derogatory attitudes, or in the event of an offense committed by the Seller or towards him, regarding his reservation, in connection with the Product Offers or with the Platform services, Mimelis reserves the right to apply suspension measures or restrictions of its Platform. When this happens, it has no impact on the rights and measures available to the Seller if he were to make claims for compensation for any wrong you have done to him.

 

These regulations are offered to you in the language of your choice, however it is important to note that it is the French version of the document that controls and governs your use of the Mimelis services.
